1. DISCLAIMER CLAUSE
I {{first_name}} {{last_name}}, agree that Trekking Africa, their agents, officers,directors, employees, volunteers, and representatives (hereafter referred to as “Trekking Africa”), are not responsible for any death, illness, injury, loss or damage of any kind sustained by any person or hiker while I am participating in the field trip and all related activities, caused in any manner whatsoever.
2. DESCRIPTION OF RISKS
2.1 I acknowledge that I am aware of the possible risks, dangers and hazards associated participating in the Hiking and/or Adventure Activities, including the possible risk of severe or fatal injury to others or myself. These risks include, but are not limited to:
a. TRAVEL: the risks associated with travel and all related activities including transport by public or private motor vehicle, buses, aircraft, etc.
b. WEATHER: any injury, illness, death, loss or damage resulting from exposure to weather elements; and/or
c. PHYSICAL: physical injuries such as muscular injuries, bruises, scrapes, cuts, sprains, dislocations, broken bones, and head, facial or dental injuries which might result from an accidental injury; illness resulting from food poisoning or parasites: and the possibilities of physical confrontations whether caused by myself or some other person or persons resulting in injuries and/or death.
d. I accept and assume all such risks, dangers and hazards and the possibility of personal injury, death, permanent disability, property damage or loss resulting thereof.
3. RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY
3.1 In consideration of Trekking Africa allowing meto participate in the Hiking and/or Adventure Activities and all related activities, I agree as follows;
a. TO WAIVE ANY AND ALL CLAIMS that I have or may have against Trekking Africa, and their members, officers, employees, students, agents and independent contractors as a result of my participation in the Hiking and/or Adventure and all related activities;
b. TO RELEASE Trekking Africa from any and all liability from any loss,damage, injury or expense that I may suffer, or that my next of kin may suffer as a result of my participation in the Hiking and/or Adventure Activities and all related activities due to any cause
whatsoever;
c. TO INDEMNIFY AND HOLD HARMLESS Trekking Africa from any and all liability for any damage including consequential damages to the property of hiking venue,Trekking Africa, or personal injury to, any third party, resulting from my participation in the Hiking
and/or Adventure and all related activities;
d. IN ENTERING INTO THIS AGREEMENT, I am not relying upon any oral or written representations or statements made by Trekking Africa other than what is set forth in this agreement.
e. FURTHERMORE,
neither Trekking Africa, the owners of the property, nor the booking agent, accept responsibility for any consequential loss sustained or suffered by the accommodation / hiking and/or adventure trail not being available through Force Majeure or for any other reason whatsoever.
4. VALIDITY
This Indemnity form is valid for one year and shall cover all Hiking and Adventure Activities undertaken through Trekking Africa for the year.
5. Rules and regulations
A. Persons on trails should keep to the demarcated routes.
B. Notice boards and symbol signs at hiking and adventure property must be obeyed.
C. Nothing but organic rubbish may be left behind.
D. No fires in cave at other spot than indicated.
E. No game, animals or birds may be molested, and shooting is strictly forbidden.
F. No vegetation, dried plant material, wood or stones etc. Are to be removed.
G. Defacing of rock faces or trees is strictly forbidden.
H. Pets are not allowed on all our hiking and/or adventure activities.
I. Please use wood, water and electricity sparingly.
J. Please use extreme care at all bridges and ladders.
K. Any hiker uses a hiking and/or adventure facilities at his/her own risk.
L. Any hiker shall be liable for any damage to hiking and/or adventure trail products and other property along the route of the hiking trail that may be caused by fire or otherwise a result of any act on the hiker’s part.
M. Should a hiker for any reason find himself/ herself in difficulty and call for help or should someone else on his/her behalf call for help, he/she or his /her parents/guardians (in case of a minor) or trekking Africa will be held responsible for the cost involved in providing the help.
N. The hikes and adventure activities organised by trekking Africa only permit persons above the age of 18 years to participate. No persons under 18 years are allowed to participate in our hikes and/or adventure activities
